Initiating Arbitration

Arbitration may be initiated one of two ways—by a claim made under a pre-dispute agreement to arbitrate, or by an agreement to arbitrate made after the dispute has arisen.

To request arbitration under a pre-dispute agreement, please do the following:

  • Complete the fillable Arbitration Claim form, including the Verification and Proof of Service, print it out, and sign where indicated.
  • Make a copy of the completed and signed Arbitration Claim form for yourself, each other party, and the MAA.
  • Serve a copy of the completed and signed Arbitration Claim form on each respondent, e.g., by first-class mail or personal delivery.
  • Mail the MAA the original and one copy of the completed and signed Arbitration Claim form, including Verification and Proof of Service, together with a check for the nonrefundable filing fee of $750. Checks should be made payable to “Maritime Arbitration Association.” Include two legible copies of the complete contract or court order upon which the arbitration is based.

To request arbitration under a post-dispute agreement, please do the following:

  • Complete the fillable Agreement to Arbitrate Existing Dispute form, print it out, and have all parties sign where indicated.
  • Make a copy of the completed and signed Agreement to Arbitrate Existing Dispute form for yourself, each other party, and the MAA.
  • Mail the MAA the original and one copy of the completed and signed Agreement to Arbitrate Existing Dispute form, together with a check for the nonrefundable filing fee of $750. Checks should be made payable to “Maritime Arbitration Association.”

After the case has been filed, we will contact you regarding the next steps to resolve your dispute. These will include including appointing the arbitrator and scheduling the hearing. You may select your own arbitrator in accordance with the Rules.

Initiating Mediation

Mediation is initiated by an agreement between the parties. The parties may contact us jointly, or one party may contact us and we will invite the other party to mediate. The mediator has no power to impose a settlement.

To request mediation, please do the following:

  • Complete the fillable Agreement to Mediate Existing Dispute form, print it out, and sign where indicated.
  • Make a copy of the completed and signed Agreement to Mediate Existing Dispute form for yourself, each other party, and the MAA.
  • Mail the MAA the original and one copy of the completed and signed Agreement to Mediate Existing Dispute form, together with a check for the nonrefundable filing fee of $250. Checks should be made payable to “Maritime Arbitration Association.”
